UPDATE - June 10, 2014: The federal court jury found Rep. Derrick Smith guilty of bribery on both counts Tuesday.
CHICAGO - June 4, 2014 - State Rep. Derrick Smith (D-Chicago) watched as an undercover FBI mole counted out 70 $100 bills - a payment prosecutors say was from a day care operator to the lawmaker for writing a letter to help her obtain a state contract.
Jurors listened Tuesday in federal court as the March 10, 2012 conversation audio played. The recording could lead them to send the active state lawmaker to prison if they find him guilty of bribery.
Smith reportedly later returned to FBI agents $2500 of the money, which he hid in his mattress.
Defense attorneys pointed to the FBI mole's own criminal history, and questioned his trustworthiness.
